<p>El Ministerio de Trabajo y Previsión Social confirmó que un almacén recibió <strong>tres infracciones por <a rel="noreferrer noopener" href="https://www.prensalibre.com/vida/salud-y-familia/el-acoso-laboral-o-mobbing-tambien-hay-que-denunciarlo/" target="_blank">el caso de un trabajador que fue agredido físicamente</a></strong> y que el video del incidente se publicó en <strong>redes sociales. </strong></p>



<p>La cartera confirmó que delegados de la Inspección General de Trabajo (IGT) se presentaron en el centro de trabajo el viernes 17 de mayo de 2024 para verificar los hechos.</p>



<p>La investigación inició luego que se difundiera <strong>un video que muestra a un empleador agrediendo físicamente a un trabajador, a quien empuja y parece reclamarle verbalmente.</strong></p>



<p>Tras la investigación, según la cartera de Trabajo, se determinó que el empleador cometió tres infracciones laborales, según informó en un comunicado.  </p>

<h2 class="wp-block-heading">Infracciones</h2>



<p>La IGT indicó que en primer lugar, se acusó al empleado de <strong>girar instrucciones en un idioma que no es el español,</strong> lo cual va en contra del artículo 9 del Código de Trabajo que prohíbe el uso de idiomas extranjeros en las comunicaciones con los trabajadores. </p>



<p>En segundo lugar, se le acusó de <strong>maltrato verbal o físico hacia un trabajador, </strong>lo cual está regulado por el artículo 61 literal c) del Código de Trabajo. </p>



<p>Y en tercer lugar, se encontró que <strong>el empleador tenía contratado a un menor de edad que <a href="https://www.prensalibre.com/?s=explotacion+laboral" target="_blank" rel="noreferrer noopener">trabajaba más horas de las permitidas por ley,</a></strong> que es de 7 horas diarias.</p>



<p>&#8220;Se ha ordenado al empleador que pague de inmediato las prestaciones laborales correspondientes al menor y que lo haga efectivo al representante o tutor legal del mismo&#8221;, indicó la cartera en el comunicado.</p>

<p>Además, se constató que el empleador no tenía el permiso del Ministerio de Trabajo para emplear a menores en su entidad, por lo que se solicitó la intervención de la Procuraduría General de la Nación para proceder al rescate del menor, precisó la cartera.</p>



<p>Por cada una de las infracciones se estableció una sanción entre dos y nueve salarios mínimos, por incumplir el Código de Trabajo. </p>
